These Terms & Conditions govern your use of Performance Signal. By creating an account, connecting services, purchasing a subscription, or using the service, you agree to these Terms.

About Performance Signal

Performance Signal is operated under the trading name Performance Signal(ABN 68 349 278 281). Throughout these Terms, "Performance Signal", "we", "us", and "our" refer to Performance Signal.

The service

Performance Signal provides natural-language access to your running and activity history through ChatGPT. The product operates by connecting authorised activity data with artificial intelligence services to help you explore, understand, and discuss your training history.

Performance Signal is an information and analytics service only. It is not a coaching, medical, healthcare, physiotherapy, nutrition, or professional advisory service.

Eligibility

You must be at least 18 years old, or have the permission of a parent or guardian, to use Performance Signal. You must provide accurate account information and have the authority to connect any accounts or data sources used with the service.

Your account

You are responsible for maintaining the security of your account and any connected services. You are responsible for all activity conducted through your account and for ensuring that you have the right to access and use any data you connect to Performance Signal.

Acceptable use

Performance Signal is intended for analysing your ownactivity history. You agree not to access or attempt to access another user's data, interfere with the platform, bypass security controls, reverse engineer the service, use automated means to abuse the platform, or use the service for any unlawful purpose.

Subscriptions & billing

Certain features require a paid subscription. Subscriptions renew automatically unless cancelled before the next billing period. You may cancel at any time and access will continue until the end of the current paid period.

Except where required by law, subscription fees are non-refundable. Refunds are not provided for change of mind, unused subscription periods, partial subscription periods, temporary service interruptions, or outages of third-party services.

Founding Member pricing

Founding Member pricing, where offered, is limited in quantity and available only to eligible accounts. Founding Member pricing is personal to the subscribing account, is non-transferable, and is forfeited if the subscription is cancelled, expires, or otherwise lapses.

Artificial intelligence & training decisions

Performance Signal uses artificial intelligence technologies, including OpenAI services, to generate responses and insights.

Responses are provided for informational purposes only and may be incomplete, inaccurate, or unsuitable for your circumstances. Performance Signal does not provide medical, healthcare, physiotherapy, coaching, training, nutritional, or professional advice.

You remain solely responsible for all training decisions, race preparation, injury management, health decisions, and any actions taken based on information generated by the service. Always apply your own judgement and seek appropriate professional advice where necessary.

Third-party services

Performance Signal relies on third-party services including Strava, OpenAI, ChatGPT, Auth0, Stripe, cloud hosting providers, and related infrastructure services.

We are not responsible for interruptions, inaccuracies, outages, account restrictions, policy changes, pricing changes, rate limits, or discontinuation of third-party services. Performance Signal may be affected by the availability and operation of those services.

Access to certain functionality requires a compatible ChatGPT account and may be affected by OpenAI platform availability, policies, subscription requirements, feature changes, or service interruptions.

If material changes to third-party services prevent Performance Signal from operating as described, we may modify, suspend, or discontinue affected functionality without liability, subject to any rights that cannot be excluded under applicable law.

Data commitment

Performance Signal does not sell user data.

Performance Signal does not use Strava activity data to train artificial intelligence models.

Performance Signal does not use Strava activity data for advertising purposes.

Performance Signal does not provide user activity data to OpenAI or other AI providers for the purpose of training foundation models.

Account deletion

Account deletion requests are processed in accordance with our Privacy Policy. Following a deletion request, access to the service may be restricted immediately while deletion is processed.

Certain information may be retained where required for legal, security, fraud prevention, accounting, operational, or compliance purposes. Further information is available in our Privacy Policy.

Availability

We aim to provide a reliable service but do not guarantee uninterrupted availability. Performance Signal is an evolving product and features, integrations, capabilities, interfaces, and availability may change over time.

Certain features may be released in beta, preview, testing, or early-access form and may contain errors, inaccuracies, or incomplete functionality.

Suspension & termination

We may suspend or terminate access where we reasonably believe these Terms have been breached, where use creates operational, legal, or security risks, where required by law, or where necessary to protect the service, users, or third parties.

Where reasonably practicable, we will provide notice of a suspension or termination and an opportunity to contact us regarding the decision, except where doing so would create a security, legal, or fraud-related risk.

Intellectual property

Performance Signal, including its software, branding, design, content, documentation, and associated intellectual property rights, remains the property of Performance Signal or its licensors. These Terms do not transfer any ownership rights to you.

Liability

Nothing in these Terms excludes, restricts, or modifies any rights or remedies that cannot be excluded under Australian Consumer Law or other applicable laws.

Performance Signal is provided on an "as is" and "as available" basis. To the maximum extent permitted by law, we are not liable for loss of data, loss of profits, revenue, business opportunities, training outcomes, athletic performance outcomes, personal decisions made using AI-generated content, interruptions caused by third-party platforms, or indirect, incidental, special, consequential, or punitive loss or damage.

Where liability cannot be excluded, our liability is limited to the maximum extent permitted by law.

Changes to these Terms

We may update these Terms from time to time as the product evolves.

Updated versions will be published on the Performance Signal website and take effect when published unless otherwise stated.

For material changes that significantly affect subscribers, we will endeavour to provide reasonable notice, including by email where practicable.

Dispute resolution

If you have a complaint or dispute relating to Performance Signal, you agree to first contact us at support@performancesignal.ai and allow us a reasonable opportunity to investigate and respond before commencing legal proceedings.

Governing law

These Terms are governed by the laws of Queensland, Australia.

Any dispute arising from these Terms or your use of the service is subject to the exclusive jurisdiction of the courts of Queensland, Australia.
